Welcome to Yumunch. By downloading, installing, or using the Yumunch app or related services (“Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use our Services.
You must be at least 13 years old and able to form a binding contract to use our Services. If you are under 18, you must have a parent or guardian’s consent. Use of the app in any jurisdiction where it is prohibited is not allowed.
You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate and complete information and update it as needed. Notify us promptly of any unauthorized use.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:
When you place an order through Yumunch, you agree to pay all applicable charges, including food, delivery, fees, and taxes. Prices and availability are set by restaurants and may change. We facilitate the transaction; the contract for food and delivery is between you and the restaurant or delivery provider. Refund and cancellation policies are as stated in the app at the time of order.
Yumunch and its content, features, and functionality (including but not limited to software, design, and branding) are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, or create derivative works without our written permission.
The Services are provided “as is” and “as available.” We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. We are not responsible for the quality, safety, or legality of restaurant offerings or third-party conduct.
To the maximum extent permitted by law, Yumunch and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.
You agree to indemnify and hold harmless Yumunch and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services or your violation of these Terms.
We may modify these Terms at any time. We will notify you of material changes via the app or by email. Your continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Services.
We may suspend or terminate your access to the Services at any time, with or without cause or notice. You may stop using the app at any time. Provisions that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will survive termination.
These Terms constitute the entire agreement between you and Yumunch regarding the Services. Our failure to enforce any right does not waive that right. If any provision is held invalid, the remaining provisions remain in effect. These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
